Seven Bays Lettings Ltd act as Agents (hereinafter referred to as the Agency) for the property Owner (hereinafter referred to as the Owner) and you, the Hirer, agree to the following conditions:-
Contract of Hire
The Contract of Hire will be between you, the Hire, and the Owner of th property for which the booking is made and shall be deemed to be made subject to these Booking Conditions and governed by English law. Seven Bays Lettings Ltd act as the Agency for the property Owner and are not Principals. The contract of Hire is not effective until the Agency despatch to the Hire written confirmation of the booking. The Contract of Hire is for hire of the property for holiday purposes only. We do not accept bookings from Hirers under 18 years of age.
Bookings will be confirmed upon receipt by Seven Bays Lettings Ltd of a Deposit of one third of the total holiday cost including any additional charges e.g. linen, pets, welcome packs, etc. Payment can be made online through our secure payment system or paid by cheque made out to Seven Bays Lettings Ltd and posted to 20 Primrose Drive, St Merryn, Padstow. PL28 8TE. If the booking is made within 8 weeks of the holiday commencement date the total price of the holiday must be paid in full at the time of booking.
Confirmation of Booking
A Confirmation of Booking will be sent to the Hirer on receipt of either one third of the total holiday cost as a Deposit or full payment of the total holiday cost if the holiday commencement date is less than 8 weeks away. The booking is taken subject to these Booking Conditions.
The balance of the total holiday cost must be received by Seven Bays Lettings Ltd no less than 8 weeks before the holiday commencement date. If the balance is not received 8 weeks prior to the holiday commencement date the holiday will be advertised for resale. If the holiday is resold up to 4 weeks prior to the holiday commencement date then 50% of the Deposit will be returned to you. If the holiday is resold less than 4 weeks prior to the holiday commencement date then 25% of the Deposit paid will be returned to you. If the holiday is not resold then the total Deposit will be retained by the Agency.
In no circumstances may more than the maximum number of persons, as stated in the property details, occupy the holiday property and only those people listed on the booking may occupy the holiday accommodation. The Agency reserves the right to terminate the Hirer’s holiday if this condition is not observed. The person who completes the booking (the Lead Name) must be over 18 years of age and a member of the party occupying the property and certifies that they are authorised to agree to the Booking Conditions on behalf of all members of the party. The Lead Name agrees to take responsibility for all members of their party. The Owner/Agency reserve the right to refuse or revoke any booking from parties that may, in their opinion and at their sole discretion, be unsuitable for the property concerned.
If you are forced to cancel your holiday you must inform the Agency (preferably by telephone to 07703-261260 or by email to Jacqui@sevenbayslettings.co.uk) as soon as possible. The day that the Agency receive your notice to cancel is deemed the date we will cancel your booking with the Owner.
If, after you have booked and paid for your holiday, you find that you cannot take it for any of the following reasons we will normally, but at the absolute discretion of the Agency, give you a goodwill refund up to the total holiday cost less a £50 handling charge. The decision of the Agency will be final in all cases:-
Death, illness, injury or compulsory quarantine of you or any member of your travelling party named on the booking, excluding pets.
Disorganisation or disruption of any UK mainland public transport service due to strike, riot or civil commotion on which you rely to reach the holiday home you have booked. Tickets will be required as proof of claim.
You or any member of your traveling party being required to undertake jury service or appear as a witness at a court of law provided you have written confirmation of your request for an alternative date refused.
Police requiring the presence of you or any member of your traveling party following fire or theft at your home or place of business.
If you cancel your holiday for any reason other than those detailed above, your holiday will be advertised for resale and is subject to the Deposit refund structure detailed under ‘Balance Payment’ above. Depending on the reason for your cancellation of your holiday, we will endeavour to give you a goodwill refund of the total holiday cost less a £50 administration charge but this does depend on the successful resale of your holiday. If we are not successful in reselling your holiday then the total holiday cost remains payable in full. The following cancellation charges will apply with regard to your deposit. Please note that any Damage Deposit taken will be returned to you in full in the event of holiday cancellation.

The Hiring Contract is made on the understanding that the property and its facilities as published will be available for the dates stated. In the unlikely event that a property is not available through events arising outside the control of the Agency, then the Agency may be forced to cancel the booking. In this event the Hirer will be advised as soon as possible and will be offered any suitable available alternative accommodation. If the alternative accommodation is not acceptable to the Hirer the Agency will issue the Hirer with a full refund. The Hirer will not as a result have any further claims against the Agency or the Owner.
The use of the holiday accommodation and amenities, where offered, is entirely at the Hirer’s risk and no responsibility can be accepted for injury, loss or damage to users’ or visitors’ belongings.
You will be responsible for the holiday property you have rented and will be expected to take all reasonable care of it for the whole period of your holiday. The property and all equipment and utensils must be left clean and tidy at the end of the hire period. The property must be vacated by 10.00 a.m. on the day of departure.
All damages and breakages are your legal responsibility as the Hirer.
You and all members of your holiday rental party are responsible for keeping the holiday home clean and tidy and agree to leave it in a similar condition as you found it in on your arrival. As the Hirer, you are legally responsible for the replacement costs of any breakage or damage in, or to,the holiday property, along with any additional costs that may result, and the cost of cleaning any excessive mess, caused by any member of your holiday rental party. This includes, but not is not restricted to, additional cleaning of furnishings, kitchen equipment, crockery, glass, lost keys, bedding and towels damaged or soiled other than by usual wear and tear. Payment will be taken out of your Damage Deposit to cover any such costs and additional payment will be requested from you if the cost of these damages/cleaning exceeds the Damage Deposit taken from you.
The Agency has the right to enter the property, without prior notice if this is not practical or possible, if special circumstances or emergencies arise, for example if repairs need to be carried out. The Agency reserves the right to repossess the holiday home at any time where you or any member of your party has caused damage. In this case the Owner or the Agency shall not be liable to make a refund of any remaining portion of the hire terms paid.
If the holiday home is undamaged and clean and tidy and in a similar condition to that in which you found it on your arrival, the damage deposit will be returned to you in full within 10 days of the end date of your holiday.
If you are bringing your dog(s) to a holiday home that permits pets, your dog must be over 6 months old at the start of your holiday, be fully house-trained and have had a current flea treatment. Bitches on heat are not permitted. Please do not allow your pets on the beds or furniture (if you cannot stop them, please bring throws or suitable covers to fully protect the furniture). Please note that the cost of cleaning any evidence of pets on furniture and bedding will be deducted from your damage deposit (bed linen is likely to be charged at replacement cost). All dogs must be kept on a lead at all times on Seven Bays Park and must not be left in the holiday home unattended. This is a park rule that is strictly enforced by the owners of Seven Bays Park who will immediately evict anyone in breach of this rule.
Arrival & Departure Times
You can arrive at your holiday home after 3.00 p.m. on the start date of your holiday rental and you must vacate the holiday home by 10.00 a.m. on the last day of your holiday. This is to allow enough time for changeover. If you plan to arrive on a day after your due arrival date, please let me know, otherwise if you do not arrive by 5.00 p.m. on the day after the start date of your holiday rental your booking may be treated as having been cancelled by you and therefore no refund of any monies paid by you will be made in this situation. Please note that if you cancel at any point before your arrival, your damage deposit will be returned to you in full.
